User Agreement

Please read these terms carefully, you must not access this website if you do not agree with these terms. By using this website you accept these terms and agree to be bound by them.

We reserve the right to amend these terms at any time at our discretion. We recommend you review the terms each time you use the website and before placing an order.

You may access and/or use the website as a guest or registered user. To become a member you must provide personal details and nominate a password. If you do not provide accurate and complete details we may not be able to activate your membership or supply products to you.

We will only permit one registration per email address and you must not use another member’s account without permission.

Conditions of Purchase

1.       A 20% deposit is required for your order to be placed. Special orders require a 50% deposit.

2.       Goods are required to be collected within 7 days of notification or will be returned to stock

3.       Staining colours are a guide only and colour variation will always occur due to the nature of timber.

4.       Variation in goods will occur due to the natural features such as knots, sap lines or other timber features.

5.       We reserve the right to alter dimensions, mouldings, or other features of the goods.

6.       Quoted delivery times are approximate and cannot be guaranteed.

7.       In the event of a customer requiring cancelling the order, a cancellation fee of 20% of the purchase price will apply.

8.       In the event of a customer requiring to cancel a special order a cancellation fee of 50% of the purchase price will apply.

9.      Customers are required to be home on their scheduled delivery day, or will be charged a redelivery fee.

10.    All goods must be paid for in full prior to delivery as delivery drivers do not accept payments.

Price

Prices shown are in Australian dollars and include GST where applicable. Prices do not include delivery and handling charges and are subject to change.

Prices for products shown on the website may be different to prices advertised in store due to freight.

Unless otherwise stated any accessories, manchester or furnishings shown in any image of products are not included in the price.

We reserve the right to correct any errors.

Delivery of Goods

The delivery address must be an address within Australia and cannot be PO Box or freight forwarding location.

You must advise at the time you place the order any difficulties that may be faced in delivering your goods, IE narrow passage ways, balconies, stairs etc.

You or someone nominated by you must be present to accept the goods at the time of delivery. If you are not home on the day of your scheduled delivery goods may be left in the safest place at your address and a picture taken and sent to you to advise of the delivery.

Delivery of goods is to your front door. Delivery does not include goods being taken inside your home. Drivers at their discretion may assist in taking the goods inside your home, but Pacific Furniture accepts no responsibility for damages to the goods or your property if goods are taken inside your property.

We offer a flat rate delivery fee of $49 to all parts of NSW, Victoria, ACT and to Brisbane Metro and the Gold Coast

All other areas delivery prices will vary from location to location

Our delivery will be conducted by one person  – you will need to assist the driver with the delivery

Minimum Purchase $500

Our delivery hours are between the hours of 6.30am - 8pm on weekdays, on rare occasions your order may be delivered on a weekend.

Delivery address must be on a sealed road.

The flat rate of $49 doesn’t include unboxing, installation or rubbish removal but an additional fee can be paid for these services.

Once your order has been placed, you will receive an email, SMS or phone call within 48 hours confirming your order, we will then contact you further once a suitable delivery date has been arranged! If your delivery date is not suitable you may contact us to advise us to arrange a more suitable date to receive the order. Pacific Furniture cannot guarantee a more suitable date however we will make all efforts to satisfy your request.

Delivery dates can be subject to change due to unforeseen circumstances, if this happens you will be contacted via SMS, Email or Phone to be made aware of your new delivery date.

Change of Mind

Please choose carefully as refunds are not normally provided where you have simply changed your mind or made a wrong selection. We recommend you carefully preview any orders before adding them to your shopping cart and proceeding with your order.

If you change your mind about a purchase before delivery, please notify the store of purchase immediately. Most of our products can’t be resold once unwrapped, due to health or hygiene reasons. If you change your mind, we may in our absolute discretion offer you a replacement, refund or credit if, you have proof of purchase, and the product and packaging are in their original condition and the product has not been used or soiled. 

Warranty

All faults must be reported within 48 Hours of the defect or fault appearing to avoid any further damage. Please keep your original order docket as proof of date of purchase and present it at the time of making a warranty claim. This warranty is in addition to the rights granted by relevant State and Federal laws, and in particular The Trade Practices Act 1974 and corresponding State Fair Trading Legislation.

Warranty commences from the date of the goods being delivered or purchased irrespective of any repair work.

Please note that these warranties do not apply for furniture used for commercial, rental trade, institutional or other non-residential use.

Our warranties do not cover:
1.    Rips, wearing, pilling, creasing or fading of fabric or leather.
2.    Damage caused by wear and tear.
3.    Damage caused by misuse or improper cleaning.
4.    Softening of foam should be expected as a result of normal use and is not to be confused with loss of resiliency.
5.    Damage incurred during handling and transportation of the product by the customer or their contractor.
6.    Discolouration of leather or fabric coverings resulting from exposure to direct sunlight, extreme heat or similar conditions.
7.    Surface scratches, dents, chips, marks or accidental breakages.
8.    Damage as a result of incorrect assembly of self-assembly products.
9.    Normal wear and tear or misuse.

If you believe your product may have a manufacturing fault, firstly locate your receipt and then please contact your store of purchase and they will arrange an inspection. Each of our manufacturers provide warranties and guarantees for faults or defects under Australian Consumer Law.

If the product fault can be safely determined by the store who sold the product, we may offer you a refund, repair or exchange. Where the product fault is difficult to determine by a store representative, we'll need to collect the item for a further inspection by the manufacturer or specialist in that field.

Repairs, Replacements and Refunds

We process all repairs, replacements and refunds in accordance with Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be acceptable quality and the failure foes not amount to a major failure.  All repairs, replacements and refunds must be managed by the store of purchase.

The warranty period commences from the date of your tax invoice. If a product is replaced under this warranty, the warranty period for that replacement product expires on the same date as the warranty period for the original product. Warranties are only available to the original purchaser of the product and are not transferable or assignable.

A major failure or defect occurs when, the product would not have been acquired by the consumer if he or she was fully aware of the extent of the defect, or, the products is significantly different from what is displayed, or the product is substantially unfit for purpose or the product is not safe.

Goods sold “as is” and where defects are explained at the point of purchase will not be covered under warranty.

Scratches, marks or abrasions, indentations or slight discolouring on timber do not constitute a major defect. Small marks, pilling, loose stitching or gathering of fabric on lounge suites or upholstered products do not constitute a major defect. Fading or deterioration caused by normal wear and tear are not subject to a warranty claim.

Improper usage or commercial usage will void any warranty. The warranty does not cover damage occurred after collection.

If the failure is minor, we reserve the right to not offer a replacement or refund. Our products come with consumer guarantees that cannot be excluded under Australian Consumer Law.

Mattresses

Mattress that is too hard or too soft is not a manufacturing defect but a comfort issue and not subject to a claim for rectification under warranty. 

A Mattress that is sagging because it is not supported by a proper base with a centre support or centre rail is not subject to a claim under warranty.

Body impressions or dips on the sleep surface in line with the normal sleep area is a normal characteristic of a plush mattress with comfort layers. These impressions are not the subject of a warranty claim unless they are greater than 35mm for the lowest point of the quilting pattern.

A mattress that is soiled in any way or has not had a mattress protector used will void any warranty.

If a refund is processed, we will refund the original purchase price in the form of the original payment method, minus any associated fees and charges. Most refunds will be processed within 7 business days, depending on your original payment method.

Warranties are a back to base warranty and it is the responsibility of the purchaser to get the goods back to the point of purchase.

Use of the Website

You agree to use the website only for the purposes for it is intended. You agree that you will not engage in any activity that interferes with or disrupts the website or the servers and networks that host the website.

You understand and agree that any suspected fraudulent, abusive or illegal activity may be referred to appropriate law enforcement authorities.

This website and its content are copyright of Pacific Furniture. Any redistribution or reproduction of part in any form is prohibited. You may not create a link to this website from another website without our written consent.

Viruses

Given the nature of the internet we cannot guarantee that this website is free from viruses, fault or other conditions that may interfere with your computer systems and we do not warrant that your access to this website will be uninterrupted , error free or that any defects will be corrected. You assume the risk of any damage to your property as a result of using this website, and to the maximum extent permitted by law.

You must take you own precautions to ensure that the process which you use for accessing this website does not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage your own computer system. We do not accept responsibility for any interference or damage to your own computer system which arises in connections with your use of this website or any linked site.

Credit Card and Bank Fraud

To the extent permitted by law we will not be responsible for any damages or consequential loses (whether direct or indirect) suffered by a user where a credit card or bank account is fraudulently used or used in an unauthorised manner.
